These Terms of Service, together with any policies, notices, or additional terms referenced in these Terms, govern your access to and use of PropEvs, available at propevs.com, including any related websites, applications, tools, features, content, subscriptions, analytics, data, and services provided by PropEvs LLC.

These Terms are a legally binding agreement between you and PropEvs LLC, a California limited liability company (“PropEvs,” “Company,” “we,” “us,” or “our”).

By accessing or using PropEvs, creating an account, starting a free trial if offered, purchasing a subscription, viewing our analytics, using SlipGen, using Esports Edge, or clicking a button or checkbox indicating acceptance, you agree to these Terms. If you do not agree to these Terms, do not access or use PropEvs.

1. Important Notice: PropEvs Is an Analytics Tool Only

PropEvs is a real-time positive expected value, or “+EV,” daily fantasy sports prop analytics and information tool. PropEvs is designed to help users compare player prop lines from third-party daily fantasy sports pick’em platforms against market data, sportsbook consensus information, and other inputs to identify props that may appear mathematically favorable based on our models and calculations.

PropEvs is not a sportsbook, casino, gambling operator, daily fantasy sports operator, payment custodian, financial institution, broker, adviser, or wagering platform.

PropEvs does not:

  • Accept, facilitate, process, or place bets, wagers, picks, entries, or DFS lineups;
  • Hold user funds for betting, wagering, DFS entries, or payouts;
  • Pay winnings, prizes, or returns;
  • Submit entries or picks to third-party platforms on your behalf;
  • Guarantee odds, lines, payouts, results, profits, or positive returns;
  • Provide personalized betting, gambling, DFS, financial, legal, or tax advice.

All decisions you make based on information available through PropEvs are made solely by you. You are solely responsible for determining whether, where, when, and how to use any information shown by PropEvs.

2. Eligibility

You may use PropEvs only if you:

  1. Are at least 18 years old, or the age of majority and legal eligibility required in your jurisdiction, whichever is higher;
  2. Are legally permitted to use DFS-related analytics tools and sports-related informational services in your jurisdiction;
  3. Are not prohibited from using PropEvs under applicable law;
  4. Can form a legally binding contract with PropEvs; and
  5. Agree to comply with these Terms.

If you are under the required age or are not legally permitted to use PropEvs where you are located, you may not access or use PropEvs.

We may restrict, suspend, or terminate access to PropEvs in any jurisdiction or for any user where we believe use may be unlawful, restricted, or create legal, regulatory, operational, or reputational risk.

3. Your Responsibility for Legal Compliance

Laws relating to daily fantasy sports, sports betting, gambling, wagering, paid contests, sweepstakes, and related activity vary by jurisdiction and may change over time.

You are solely responsible for understanding and complying with all laws, rules, regulations, platform terms, and eligibility requirements that apply to you, including those related to:

  • Daily fantasy sports;
  • Sports betting;
  • Pick’em-style contests;
  • Gambling or wagering;
  • Age restrictions;
  • Location restrictions;
  • Tax obligations;
  • Third-party DFS platform rules;
  • Responsible gambling or self-exclusion programs.

PropEvs does not guarantee that PropEvs, any third-party DFS platform, any sportsbook, any prop, any slip, or any related activity is lawful in your jurisdiction.

4. No Personalized Advice

PropEvs provides general analytics, data, calculations, rankings, comparisons, tools, and informational content. PropEvs does not provide personalized recommendations or advice tailored to your financial situation, risk tolerance, betting history, location, DFS platform eligibility, personal circumstances, or legal status.

Even if PropEvs displays a prop, slip, rating, expected value estimate, projection, suggested combination, or other signal, that information is not a recommendation that you personally place a bet, submit a DFS entry, make a financial decision, or take any action.

You should not rely on PropEvs as your sole basis for any decision. You are responsible for evaluating all information independently.

5. Responsible Gambling and DFS Play

PropEvs is an analytics and information tool, but the information may relate to DFS platforms, sports props, betting markets, and gambling-adjacent activities. You should use PropEvs responsibly.

You should not use PropEvs or any third-party DFS or betting platform if doing so may cause financial, emotional, legal, or personal harm. You should never risk money you cannot afford to lose.

If you believe you may have a gambling problem, or if your use of DFS, sports betting, or similar products is causing harm, seek help immediately. In the United States, you may contact the National Problem Gambling Helpline at 1-800-GAMBLER or visit ncpgambling.org for resources.

PropEvs may suspend or terminate your access if we believe your use of the service creates safety, responsible gambling, legal, or compliance concerns.

6. Description of the Service

PropEvs may provide features including, but not limited to:

  • Real-time +EV DFS prop analytics;
  • Player prop line comparison;
  • DFS pick’em app line tracking;
  • Sportsbook market and consensus comparisons;
  • Mathematical expected value calculations;
  • SlipGen suggested optimal slips;
  • Esports Edge line comparison for CS2, League of Legends, Valorant, Call of Duty, and other esports;
  • User settings and preferences;
  • Saved or hidden slips;
  • Column order, book selections, and weighting preferences;
  • Limited free previews;
  • Subscription-based access to premium tools.

We may add, modify, limit, suspend, discontinue, or remove any feature at any time, with or without notice.

7. Third-Party Platforms and Data Sources

PropEvs may display, reference, compare, scrape, aggregate, process, or analyze information related to third-party DFS platforms, sportsbooks, sports data sources, markets, teams, players, athletes, games, props, lines, prices, or related content.

Third-party platforms may include, but are not limited to, PrizePicks, Underdog, Betr, Dabble, Pick6, Splash, Bleacher Nation, Pinnacle, and other DFS, sportsbook, or market-data sources.

PropEvs is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party DFS platform, sportsbook, league, team, player, data provider, or brand unless expressly stated by PropEvs in writing.

Third-party names, trademarks, logos, and brands belong to their respective owners and are used for identification and informational purposes only.

We do not control third-party platforms or data sources. Third-party lines, odds, prices, projections, availability, contest rules, payouts, and market conditions may change quickly and may be inaccurate, delayed, incomplete, unavailable, or different from what appears on PropEvs.

You are solely responsible for confirming all information directly with the applicable third-party platform before taking any action.

8. Accuracy, Availability, and No Guarantees

PropEvs attempts to provide useful analytics and information, but we do not guarantee that any data, calculation, prop, expected value estimate, line, sportsbook comparison, slip, projection, ranking, result, or other content is accurate, complete, current, profitable, or available.

You understand and agree that:

  • Lines and prices may change rapidly;
  • Third-party platforms may suspend, remove, or modify props;
  • Scraped or aggregated data may contain errors;
  • Sportsbook market data may be delayed or unavailable;
  • Calculations may be based on assumptions or incomplete information;
  • Positive expected value does not guarantee profit;
  • Historical performance does not guarantee future results;
  • Suggested slips may lose;
  • Any prop, bet, pick, entry, or contest may result in financial loss.

PropEvs makes no guarantee that you will win money, avoid losses, identify profitable plays, or achieve any specific outcome.

9. Accounts and Authentication

To access certain features, you may need to create an account or authenticate using Google Auth through Supabase.

You agree to provide accurate and complete information and to keep your account information current. You are responsible for maintaining the confidentiality and security of your account, login credentials, devices, and sessions.

You are responsible for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our gross negligence or willful misconduct.

You must notify us promptly at support@propevs.com if you believe your account has been compromised.

We may suspend, restrict, or terminate your account if we believe you have violated these Terms, created risk for PropEvs or other users, used PropEvs unlawfully, attempted to abuse the service, or engaged in conduct we deem harmful.

10. Subscriptions, Free Trials, Discounts, Billing, and Auto-Renewal

PropEvs offers paid subscription plans. Current or future plans may include weekly, monthly, annual, promotional, discounted, trial, or other subscription options.

Prices, features, billing periods, renewal terms, discounts, promotional offers, and free trial availability may vary and may change over time. Any specific subscription terms presented to you at checkout are incorporated into these Terms.

PropEvs may, from time to time, offer free trials, discounts, promotional pricing, coupons, or other special offers. We are not required to offer any free trial, discount, or promotional offer, and we may modify, limit, revoke, or discontinue any offer at any time, subject to applicable law and the terms presented at checkout.

10.1 Automatic Renewal

Unless otherwise stated at checkout, subscriptions automatically renew at the end of each billing period until canceled.

By starting a free trial if offered, accepting a promotional offer, or purchasing a subscription, you authorize PropEvs and its payment processor, Stripe, to charge your selected payment method for recurring subscription fees, applicable taxes, and other charges disclosed to you at checkout.

10.2 Free Trials, Discounts, and Promotional Offers

PropEvs may offer free trials, discounts, promotional pricing, coupons, or other special offers from time to time. Eligibility, duration, pricing, features, renewal terms, and other conditions will be disclosed at checkout or in the applicable offer.

If a free trial is offered, you may be required to provide a payment method. Unless otherwise stated at checkout, your subscription may automatically convert to a paid subscription when the trial ends unless you cancel before the end of the trial period.

If a discount or promotional price is offered, the discounted price may apply only for the period disclosed at checkout. After the promotional period ends, your subscription may renew at the then-current standard price unless you cancel before renewal.

You are responsible for reviewing the offer terms before accepting a trial, discount, or promotion. PropEvs may limit eligibility for trials, discounts, and promotions and may modify or discontinue offers at any time, subject to applicable law.

10.3 Payment Processing

Payments are processed by Stripe or another payment processor we may use in the future. PropEvs does not store full credit card numbers.

Your payment information is handled by the payment processor and may be subject to that processor’s own terms and privacy policy.

10.4 Failed Payments

If your payment method fails, we may attempt to charge it again, request updated payment information, suspend your subscription, limit access, or terminate your subscription.

You remain responsible for unpaid amounts to the extent permitted by law.

10.5 Cancellation

You may cancel your subscription through the account, billing, customer portal, checkout management flow, or other cancellation method made available by PropEvs or Stripe.

Cancellation stops future renewal charges but does not necessarily provide a refund for the current billing period unless required by law or expressly stated by PropEvs.

After cancellation, you may continue to have access until the end of the paid billing period unless otherwise stated.

10.6 Refunds

Except where required by law, payments are non-refundable. PropEvs may consider refund requests at its discretion, but granting a refund in one case does not require us to grant refunds in the future.

10.7 Changes to Pricing or Subscription Terms

We may change subscription prices, features, free trial terms, discount terms, promotional terms, renewal terms, or billing terms. If required by law, we will provide notice and obtain any required consent before changes take effect.

11. Acceptable Use

You agree not to:

  • Use PropEvs for any unlawful purpose;
  • Use PropEvs if you are underage or prohibited from using DFS-related tools;
  • Violate any applicable law, regulation, or third-party platform rule;
  • Copy, scrape, crawl, harvest, extract, or bulk download data from PropEvs without permission;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from PropEvs;
  • Interfere with, disrupt, overload, or compromise PropEvs systems;
  • Circumvent paywalls, authentication, rate limits, usage limits, access controls, or security features;
  • Share, resell, sublicense, publish, or redistribute paid PropEvs data or analytics;
  • Use bots, scripts, automated tools, or unauthorized APIs to access PropEvs;
  • Upload or transmit viruses, malware, or harmful code;
  • Attempt to gain unauthorized access to accounts, systems, or data;
  • Misrepresent your identity or affiliation;
  • Use PropEvs to harass, abuse, threaten, or harm others;
  • Use PropEvs in a way that creates legal, regulatory, operational, or reputational risk for PropEvs.

We may monitor usage for security, abuse prevention, and enforcement. We may suspend or terminate accounts that violate these Terms.

12. User Settings and User Content

PropEvs may allow you to save preferences, settings, filters, book selections, weights, hidden slips, column order, or similar account-related configurations.

You are responsible for the information and preferences you submit, save, or configure. You grant PropEvs a limited right to process, store, display, and use this information as necessary to provide and improve the service.

You represent that you have the rights necessary to submit any information you provide and that your information does not violate law or the rights of others.

13. Intellectual Property

PropEvs, including its software, design, interface, features, models, calculations, organization, branding, logos, text, graphics, workflows, analytics presentation, and other content, is owned by PropEvs or its licensors and is protected by intellectual property and other laws.

Subject to these Terms, PropEvs grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use PropEvs for your personal, non-commercial use.

You may not copy, reproduce, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, reverse engineer, or create derivative works from PropEvs except as expressly permitted by us in writing.

14. Feedback

If you submit suggestions, ideas, bug reports, feature requests, comments, or other feedback, you grant PropEvs a worldwide, perpetual, irrevocable, royalty-free right to use, copy, modify, distribute, display, and otherwise exploit that feedback for any purpose without compensation or obligation to you.

15. Privacy

Your use of PropEvs is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

By using PropEvs, you acknowledge that you have reviewed our Privacy Policy.

16. Service Availability and Changes

PropEvs may be unavailable from time to time due to maintenance, updates, outages, data-source issues, hosting issues, third-party failures, security incidents, technical problems, or other reasons.

We do not guarantee uninterrupted, secure, or error-free availability.

We may modify, suspend, or discontinue all or part of PropEvs at any time, with or without notice.

17. Beta, Experimental, and Informational Features

Some PropEvs features may be experimental, incomplete, or provided in beta form, including analytics models, line comparison tools, SlipGen, Esports Edge, and other features.

Beta or experimental features may be changed, removed, inaccurate, unavailable, or unreliable. You use such features at your own risk.

18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEVS IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEVS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND QUIET ENJOYMENT.

WITHOUT LIMITING THE FOREGOING, PROPEVS DOES NOT WARRANT OR REPRESENT THAT:

  • THE SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • ANY DATA, LINE, PROP, EXPECTED VALUE CALCULATION, SLIP, PROJECTION, OR ANALYTIC WILL BE CORRECT OR PROFITABLE;
  • THIRD-PARTY DATA WILL BE AVAILABLE, ACCURATE, OR CURRENT;
  • YOU WILL WIN MONEY, AVOID LOSSES, OR ACHIEVE ANY PARTICULAR RESULT;
  • ANY THIRD-PARTY DFS PLATFORM, SPORTSBOOK, MARKET, OR PROP WILL REMAIN AVAILABLE;
  • PROPEVS WILL MEET YOUR NEEDS OR EXPECTATIONS.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEVS LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, PERSONAL LOSSES, BETTING LOSSES, DFS ENTRY LOSSES, GAMBLING LOSSES, OR FINANCIAL LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPEVS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO PROPEVS IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

20. Assumption of Risk

You understand and agree that using PropEvs involves risks, including risks related to inaccurate data, delayed data, changing lines, incorrect calculations, model error, third-party platform restrictions, legal restrictions, financial loss, and gambling-related harm.

You knowingly and voluntarily assume all risks associated with your use of PropEvs and any decisions you make based on information available through PropEvs.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PropEvs LLC and its owners, members, managers, officers, employees, contractors, agents, service providers, licensors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your use or misuse of PropEvs;
  • Your violation of these Terms;
  • Your violation of applicable law or third-party rights;
  • Your use of third-party DFS platforms, sportsbooks, or related services;
  • Your bets, DFS entries, picks, slips, wagers, financial decisions, or related activity;
  • Your violation of third-party platform rules;
  • Information or content you submit to PropEvs;
  • Your fraud, misconduct, negligence, or willful misconduct.

We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with us.

22. Suspension and Termination

We may suspend, restrict, or terminate your access to PropEvs at any time if we believe:

  • You violated these Terms;
  • You used PropEvs unlawfully or abusively;
  • Your account creates risk for PropEvs, other users, or third parties;
  • You attempted to circumvent payment, access controls, rate limits, or security features;
  • Your use may violate law or create regulatory risk;
  • Continued access would be harmful, unsafe, or inappropriate.

You may stop using PropEvs at any time. Subscription cancellation is handled separately under the subscription and billing terms above.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and payment obligations.

23. Communications

You agree that we may send you service-related communications, including account, authentication, security, billing, subscription, legal, and transactional notices.

Transactional emails may be sent through Supabase Auth, Stripe, or other service providers.

If we later send marketing emails, you will be able to opt out as required by applicable law. Even if you opt out of marketing communications, we may still send transactional or service-related messages.

24. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms, updating the “Last Updated” date, sending an email, displaying an in-product notice, or using another reasonable method.

Your continued use of PropEvs after updated Terms become effective means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using PropEvs and cancel any subscription.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law preempts California law.

26. Dispute Resolution; Informal Resolution

Before filing any formal claim, you agree to first contact PropEvs at support@propevs.com and provide a brief written description of the dispute, your contact information, and the relief you seek.

You and PropEvs agree to attempt to resolve the dispute informally for at least 30 days before either party initiates a formal proceeding, unless doing so would be prohibited by law or would cause irreparable harm.

27. Venue

Subject to any arbitration agreement or small claims rights that may be added in the future, you and PropEvs agree that any legal action arising out of or relating to these Terms or PropEvs will be brought exclusively in the state or federal courts located in California, unless applicable law requires otherwise.

You and PropEvs consent to personal jurisdiction and venue in those courts.

28. Injunctive Relief

You agree that a breach of sections relating to intellectual property, unauthorized access, scraping, redistribution, reverse engineering, or misuse of PropEvs may cause irreparable harm for which monetary damages would be inadequate.

PropEvs may seek injunctive or equitable relief without posting a bond, to the extent permitted by law.

29. Force Majeure

PropEvs will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, internet or hosting failures, cyberattacks, labor disputes, war, terrorism, civil unrest, government action, regulatory changes, third-party platform changes, data-source outages, payment processor failures, or other events beyond our control.

30. Assignment

You may not assign or transfer these Terms or your rights or obligations under these Terms without our prior written consent.

PropEvs may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or by operation of law.

31. Severability

If any provision of these Terms is found unenforceable, invalid, or unlawful, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

32. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision or any other provision in the future.

33. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented to you, constitute the entire agreement between you and PropEvs regarding your use of the service and supersede any prior or contemporaneous agreements on that subject.
